Commentary:
Unbelievable. According to the local papers, a man took two power
saws from a workbench belonging to private contractors/electricians at
a train station, and attacked people with them. One unlucky
rider, on his way to work at a post office, was attacked repeatedly and
then robbed.
This guy is really lucky to be alive. But what disturbed me was
the fact that no one helped him. There were a lot of witnesses to
the attack, but nobody helped him. If the attacker was
gang-tackled, and each arm was restrained, nobody would have been hurt
by the saws. We're just fortunate that this did not turn into
another Kitty Genovese incident.
And if the victim decides to sue, I would hit the MTA and the private
contractor with the suit. The contractors left the tools
unattended, and I would argue that it's foreseeable for someone to come
along and use the saws to attack people. And therefore leaving
the tools unattended constitutes negligence. The MTA hired the
contractor, and is liable for the contractor's negligence.
Hopefully the victim will have a full and speedy recovery.
